What is the Sealed Section?
The 'Sealed Section' is a restricted area on our site where artwork images identified for mature viewing only have been stored.
ArtInvesta is not censored or moderated in any way. You must be 18+ to enter the 'Sealed Section' and accept responsibility for doing so.
Any unlawful activity will be flaged and dealt with by the authorities.

How does CASSA work?
The Artwork Condition and Secure Sale Administration (CASSA) Service is inbuilt into the ArtInvesta Site and designed to make the buying and selling experience online as secure as possible for all parties involved. It is an integral part of the services provided to facilitate financial transactions between buyers and sellers of artworks.
To seller authorises ArtInvesta CASSA service to receive payment and hold such payments until the buyer receives and accepts the goods after completing all required condition reports.
The buyer agrees that if they fail to complete a condition report within a reasonable timeframe as specified by ArtInvesta; the transaction will be deemed as having been completed in accordance with the relevant dispatch condition report provided by the seller.

What is CASSA?
CASSA is short for Artwork Condition and Secure Sale Administration.
It is an in-house ArtInvesta facility and as such not regarded as a third party to the service. This service may, in the future, be outsourced and you give your authority, for the transfer of all relevant data required to facilitate the required transaction.


What are SOFIA principles?
ArtInvesta operates under a set of guiding principles. These principles will be considered in all ArtInvesta actions and activities. The principles are represented by the acronym “SOFIA.”

What is an art genre?
Basically it’s a fancy name for the style of artwork you have created.
For example if you painted a lifelike picture of your cat you might select – Pet Portrait. Or if you sketched a country scene while you were on holiday you might select – Landscape.

Why is the artwork story so important?
The artwork story explains why you created your artwork.
When the artwork story appeals to a potential buyer they are more likely to buy the piece.
If you are not confident writing your story - consider recording it on your iPhone or other recording device and then type it up. Or ask a friend to transcribe your words as you describe your work.
This example of an artwork story may help you to craft your own. It is for an artwork titled "The Golden Landscape",
Every morning I would wake in pain before the sunrise. Looking from my window I longed to walk barefoot along the beach and to feel the first warm rays of the dawn on my skin.
Trapped in my crippled body the canvass became my beach, the brush stokes became my journey and the golden colours of my pallet became the warmth on my skin. As my artwork “The Golden Landscape” took shape so I recovered.
There is no right or wrong way to write the artwork story. What's important is that it comes from the heart.
Can I upload artwork for free?
Absolutely. As much and as often as you like...
No fees for uploads or gallery space now or in the foreseeable future.
Does my artwork have to be an original?
Yes, artists must offer original artworks and associated Intellectual Property ONLY; no copies, prints or reproductions will be accepted for sale.
The artist must be the originator of the artworks offered for sale and accept all responsibility and provide proof of the authenticity of the original artwork.
What materials can be used to create art legally?
Artists must be fully aware of what can and cannot be traded legally, including what materials can and cannot be used according to law.
i.e. Artworks painted on ivory, human remains, some types of wood, etc cannot be traded online via our website.

Why do I have to maintain the status of the artwork?
The status of an artwork (original and intellectual property) listed on Artinvesta may only be changed by the owner or in certain circumstances by ArtInvesta.
It is a requirement that owners ensure that the status of their submissions and acquisitions are accurately maintained otherwise they are in breach of the Terms of Use.


What does ArtInvesta do with flagged artworks?
ArtInvesta will provide Users with a facility to flag listings.
Flagged listings will be investigated by ArtInvesta and appropriate action taken at ArtInvesta’s discretion.
ArtInvesta is not obliged to provide feedback on the action we take on a flagged listing.
What type of artwork can be listed on ArtInvesta?
ArtInvesta services are offered for, but not limited to, the following type of original artworks and the associated intellectual property:
- Paintings
- Drawings and Illustrations
- Sculptures and Models
- Textile Art
- Digital Art Prints (IP and 1st certified production ONLY)
- Photographs (IP and 1st certified production ONLY)

Can I list the same artwork on other sites?
We encourage Artists to use as many methods as possible to increase their exposure.
Accordingly artworks may be uploaded on other commercial sites, social networking sites and personal websites. If permitted by the terms of use of these online venues you may add links to your ArtInvesta Personal Gallery space.
However we ask that artworks NOT be offered for sale on any other site whilst offered for sale on ArtInvesta . We recommend directing sales traffic to your personal ArtInvesta gallery where both the buyer and the seller is protected during the purchasing process.

Can I list and sell an artwork I currently own?
If you are the artist, created the original work and have rights to the associated Intellectual Property then the artwork can be listed for sale on ArtInvesta.
If you purchased an artwork and are not the originating artist then you cannot sell the artwork on the ArtInvesta website at this time.
However, if you bought the original artwork from the ArtInvesta website, yes you can re-list it for sale.
Can I sell prints or reproduction of artwork?
No.
The Site does not offer space for the sale and trading of prints, limited editions, reproductions or copies.
We are NOT a print on demand or vanity publishing service. We focus on originals, copyright and licenses.
What happens if I don’t want my artwork to be re-listed?
If you do not wish to re-list your artwork you must opt out of that service once the purchase has been confirmed.
This is actioned by updating the status of the artwork to reflect your decision not to have it re-listed.
Can I re-list my artwork after I have taken it off the Trading System?
If for any reason an owner chooses not to re-list or to sell the artwork away from the ArtInvesta site, say through a gallery or traditional auction house, the artwork cannot be automatically re-listed with Artinvesta.
You may seek to re-list the artwork by submitting a written application which may be considered at ArtInvesta’s sole and exclusive discretion.
Where are the offers I have made?
To view all the offers that you have made simply log in to your account on Artinvesta. Then click on “My Portfolio” on the top right of a web page. From the porfolio home page click on the “OFFERS MADE” menu option on the left side of the page. You should now see a page showing you all your offers, tab separated.

Can anyone post artwork for sale on ArtInvesta?
Yes however you must be over the age of 18.
Minors who wish to post artwork must have parental/guardian authority to open an account and the parent/guardian agrees to act on their behalf in the contractual obligations between parties.
The parental/guardian authority service is part of our evolution plan. We will Facebook and tweet when it comes on line.

Are the artworks submitted to ArtInvesta censored?
No.
The artworks submitted to ArtInvesta are not censored. All site material is unrestricted and may be controversial and/or offend some viewers.
The uncensored material may include nudity or other graphic content unsuitable for children.
Some material may be considered illegal in some countries and users agree not to access material deemed illegal in their country.
ArtInvesta will provide facilities to allow users to flag and filter unsuitable material.
ArtInvesta takes no responsibility or liability for the material posted on this Site.

When does change of ownership take place?
Each time the art passes from seller to buyer a record of the artwork is updated to include the following information; it’s condition at the time of sale, its new location, the identity of the new owner and the value of the successful offer.
The ownership of the artwork is only assigned to the submitting artwork on the submission of all required information in accordance with the Terms of Use.
The ownership of a successful buyer is assigned when all relevant reports and information requirements are satisfied.
In the case of a claim or dispute ArtInvesta will be the sole determiner of the ownership status of the Artwork and its Intellectual Property.
How do I make an offer for original artwork, copyright and/or licenses?
First register as an Investor/Buyer. It’s easy and quick.
Decide on artwork or copyright you like and complete the offer forms.
Remember ArtInvesta’s offer system is unique to the online art world. You may want to place multiple timed bids against the same piece or copyright or utilize other buying strategies to entice the seller.
In Version 2 we will introduce the sale and trade of artwork Licenses. Notices of availability will be posted on Facebook, Twitter and via email to our database - so stay registered!
Can I sell my artwork for a fixed price?
This facility is offered exclusively to artists.
Every original artwork created and advertised by the artist of origin can be sold for a fixed price if this is what the artist chooses.
Buyers/investors of artwork purchased via the ArtInvesta Site who wish to resell may not re-list a work for a fixed price.
All re-listing is directed through the ArtInvesta Trading System - also known as the offer and acceptance system. This service attracts a 10% commission fee + PayPal fees.
How does the Temptation Price work?
The Temptation Price is a function available on the offer and acceptance system only. The artist or owner has the choice to set an undisclosed Temptation Price.
The Temptation Price is 'SECRET' - the buyer cannot see the amount.
When an offer is made on an artwork notification via email is sent to the potential buyer and the current owner. If the price is 'way off ' the Temptation Price email encourages the potential buyer to try again! If it is close to the Temptation Price the email notifies them accordingly.
All offers are relayed to the artist or owner of the artwork.
The artist or owner can accept any offer at their discretion.
The Temptation Price is not a Reserved Price. ArtInvesta works on free market principles and as a consequence does not use reserve prices.

Can I sell an artwork if I do not own the copyright?
Artists who do not own the sole copyright of the artwork they submit, may not list that artwork on ArtInvesta because they are unable to offer the free personal online use license required by ArtInvesta.
Buyers and investors who have purchased artwork from ArtInvesta may re-list the artwork for sale on the ArtInvesta website.
ArtInvesta is a 'trading' site.
Do I have an option to BUY it now?
Yes.
If an artist offers an original artwork for a fixed price rather than using the offer system, a buyer can purchase the piece immediately.
The fixed price option is not available for intellectual property.
Failure to complete the transaction is a breach of the Terms of Use. ArtInvesta reserves the right to take action to protect all complying parties in accordance with the Terms of Use if a transaction is not completed.

Can I cancel my offer once it has been accepted?
You cannot withdraw from completing a transaction once the offer has been accepted by the seller.
Sales are final unless the item is found to be not as described, not as per the condition report, fraudulent or damaged.
Where these instances occur the buyer is required to notify ArtInvesta of a claim in a timely manner.

Can I Download images for free?
Yes.
A free personal private online use licence is offered to all Users of ArtInvesta if they comply with these Site Rules as well as our Terms of Use.
Submitting artists accept that it is in their interests and a condition of this Agreement that all images be available for personal private online use.
This license is final, permanent, continuous, global, non-exclusive, royalty-free and sub-licensable by ArtInvesta International.
Are there limits of use for the free downloading of images?
The free license extends to the downloading of low resolution versions of all artwork images available on the Site for personal use only.
Use of any image in any other way could be viewed as a breach of copyright and is illegal.
Do I have to register to download artwork?
No, you do not need to register to download artwork as this is a free service for all users of the site.
However, we do encourage you to become a member of ArtInvesta and become a part of our community.


How does the free personal online use license work?
A free private personal online use license is granted by the originating artist by virtue of the submission process to ArtInvesta and in perpetuity. This license extends to ArtInvesta for the exhibition, promotion and display of submitted artworks and sublicensed to ArtInvesta Users for their personal private online use in accordance with the provisions of the Terms of Use.
Artists or Intellectual Property Owners retain all their Intellectual Property rights subject to the licenses granted to ArtInvesta and its Users.
This license continues when an artist sells their copyright to any buyer.

How does the Artist benefit from the free download of images?
Each time a low resolution image is legitimately downloaded the ArtInvesta website officially counts and records the activity.
Statistics gathered on the Site will be used as promotional material as deemed appropriate by ArtInvesta International.
Artists will be financially rewarded for their share of download activity on the Site via a performance dividend. Performance dividends paid to artists are calculated on the number of legitimate public downloads.
Downloads, comments, ratings and other statistical data will be gathered to assist in giving a true market valuation of the artwork.
Can I rate and comment on the artwork without registering?
Correct. No need to register. Just go ahead and rate and comment as you like.
The Value of an artwork can be significantly affected by the art lovers’ response. And to ensure the feedback is genuine you will have to enter a security code when rating and commenting so that we know you are an actual person and not a robot.

When are the funds released to the seller?
ArtInvesta will hold the funds until such time as the buyer notifies ArtInvesta that the work has arrived, that it has been accepted and is in the condition as purported prior to the sale.
The funds are then released to the seller into their Pay Pal account and the transaction is complete.

What services attract fees?
Fixed prices sales attract the PayPal fees. NO commission is deducted by ArtInvesta. This is a free service to Artists.
Sales through the ArtInvesta offer and acceptance system, our version of an online auction, attract a commission fee of ten percent (10%) plus the PayPal fees.

What other charges apply to the sale?
PayPal charges apply to all transactions – this is paid directly to PayPal at the time of the transaction.
Paypal also charge for currency conversions and use of credit cards and Users agree to accept Paypal Terms of Use in these instances.
ArtInvesta does not receive a commission or payment from PayPal for these transactions.
ArtInvesta reserves the right to charge for additional services and products including but not limited to; high level investment reports, artwork almanacs, artwork valuation services. The charges for these items will be notified on the website when they are available for purchase.

Do I have to pay taxes on the artwork sold?
You must pay tax on sales if and as required by law and meet all your legal liabilities.

Seek advice in your country regarding your obligations.
ArtInvesta does not enter into financial transactions between buyers and sellers - rather facilitates the transaction - ArtInvesta is not responsible for the collection of taxes.

Do I receive royalties on the sale of my artwork?
Yes.
Artists royalty payments on all future sales of artwork provided that artwork is maintained and sold through the ArtInvesta Trading system.
This payment system is designed to continually recognise and reward the artist. It is exclusive to ArtInvesta and not associated with the commercial royalty scheme.

How does the Artist Performance Dividend work?
ArtInvesta has set aside fourteen percent (14%) of the equity in the holding company Dimax Solutions Pty Ltd for the purpose of providing contributing artists with a performance dividend for submission of their artworks.
Each time an art lover (the public) downloads a free low resolution version of an artists image for private use - the downloads are counted. The more downloads the higher the dividend paid to the artist.
The downloads must be genuine.
The dividend continues to be paid for the term of the artists registration.

How do I get paid by ArtInvesta?
You must create and maintain a Paypal account and receive all monies from ArtInvesta via that account.


What is AQUIPS?
AQUIPS stands for Article Quick Tips.
AQUIPS is an article based user contributed information resource. Using “AQUIPS” is a helpful and community oriented way to share information from all over the world.
AQUIPS assists users in the Trading experience by offering global knowledge on all aspects of the art world including guidance on buying artworks.


How does AQUIPS work?
By following the rules and adding important, factual, enlightening and constructive information the whole community can benefit from a wealth of shared knowledge and a valuable resource accessible by the global community.

When do I have to dispatch the goods?
The artwork must be dispatched immediately once the payment is confirmed by ArtInvesta
ArtInvesta will contact you and advise you of the details via email.

What are my transport obligations?
In the majority of cases the seller is responsible for the cost of postage/transportation of the artwork. It is pertinent to factor these costs into the advertised sale price. If using the offer and acceptance system the seller should investigate the postage/transportation before accepting an offer.
The seller must correctly package and meet all transportation arrangements agreed to with the buyer.
Failure to do so may result in damage. The seller may be deemed responsible and have to pay the costs.
ArtInvesta recommends care and attention be paid to packing and insuring/registering the package. This helps to resolve a dispute should one arise.

When should I complete a condition report?
Condition Reports are essential and a requirment of the Site terms and conditions.
You must complete a condition report when:
- An artwork is uploaded for sale
- A change in condition of the original artwork is identified
- The artwork is sold (prior to postage)
- When you buy artwork (on receipt of your purchase)
Condition reports assist in the buying and selling process and provide valuable information to assist with dispute resolutions and insurance claims.

What happens if I don’t submit a Condition Report?
Owners and sellers are obliged to submit a condition report in a timely manner otherwise ArtInvesta will make the reasonable assumption that the artwork is in the condition of the original artwork or is as per the last submitted condition report and any further transaction on that original artwork will assume that condition.
Failure to complete a condition report may lead to a dispute and without sufficient evidence ArtInvesta will be forced to reconcile the dispute based on the information on our system.

What happens if the condition of the artwork changes?
If an original artwork is damaged in any way, beyond repair, lost or stolen the current owner will be responsible for completing a change of condition report on the website.
A permanent digital record of the image will remain but the original artwork will no longer be available for sale.
The intellectual property listing of the artwork remains unaffected.

What do I do when a dispute arises?
In the first instance the buyer notifies ArtInvesta of any concerns.
Artinvesta facilitates communication between the parties in an effort to resolve any dispute directly.
Users agree to allow ArtInvesta to act on their behalf to expedite this process.
